The mounting number of civil rights violations against Muslims, Arabs, South Asians and anyone who is perceived to be of Middle Eastern heritage, is alarming. These violations are committed by our law enforcement, private and public institutions, as well as ordinary citizens.

Can the NYPD Comply With Basic Rules?

The NYPD seems to persist in not following the most basic rules enacted to protect the constitutional rights of the citizens of New York City. The report found that the NYPD failed to submit the required paperwork to open or extend investigations into the political activity of our citizens, and that in the few instances where the rules were followed, the same boilerplate documents were submitted in every case.

Sharia Compliant Wills: Principles, Recognition, and Enforcement, 57 N.Y.L. Sch. L. Rev. 259 (2012–2013)

In ensuring that Sharia-compliant wills that are also in line with state law, practitioners will likely face certain challenges. This article seeks to identify and address the following challenges: conflicts between U.S. intestacy laws and Islamic inheritance laws; conflicts with the Establishment Clause of the First Amendment of the U.S. Constitution; and potential public policy conflicts arising from the enforcement of certain interpretations of Sharia law.

As the Muslim population continues to expand, the area of Shariah-compliant wills offers practitioners a new and interesting field to explore. Due to its complexity and its differences with the established legal theories of intestacy laws in the United States, Islamic inheritance law proves to be an engaging and important subject.

International Trade and Investment in Algeria: An Overview, 18 Mich.J.Intl L. 376 (2010)

Algeria emerged from the turbulent 1990s with an eye towards economic expansion and openness toward the world economy. This trend continues to characterize Algeria’s market reforms, demonstrated by ever-increasing market liberalization and international integration. Since entering office in 1999, President Abdelaziz Bouteflika has championed economic diversity by steering the country away from an overreliance on oil production and by attracting foreign trade and investment. While growth remains slow and unemployment continues to be a national concern, Algeria’s efforts appear to be moving the country in the right direction. The actions of the last decade create an appealing environment to foreign investors and businesses, thereby assuring growth and development through investment. Such measures will ensure a continued influx of foreign partners that would not only introduce the Algerian economy to foreign markets but would also offer trade in services training to the Algerian labor force.

Shariah-Compliant Wills: A Primer

The Law Firm of Omar T. Mohammedi, LLC authored an article on Islamic Wills that was featured on Tri State Muslim.

Remembrance of death and the afterlife is a cornerstone of the Islamic ethos. Nevertheless, when it comes to inheritance many Muslims living in the United States fail to make the arrangements necessary to ensure their legacy will pass under the precepts of Islamic Shariah law, and as a result their possessions will be disposed of in a manner suitable to the State, but not Shariah law. After one’s death, it is too late, in any American jurisdiction, for relatives to dictate to a court of law how the decedent would have wanted his or her possessions to be distributed. All jurisdictions, without exception, will ignore such pleas and apply their own laws of intestacy, laws that govern how an estate will be distributed upon death absent a will. Such laws will hardly conform to Shariah law.
