In a decisive blow to the principles of open government, due process and protections against abuse by the New York City Police Department (“NYPD”), the Appellate Division First Department ruled today that the NYPD can respond to a New York State Freedom of Information Law (FOIL) request by neither admitting nor denying the existence of records responsive to the request.
